Two dui's two different states

I recently received a DUI charge in the sate of NJ. However, at the time of the arrest no one was driving the vehicle. It was pulled over on the side of the road and we were changing drivers because I was under the influence. The police then drove up behind the vehicle and arrested me using all the procedures for DUI.

I also have had a first offense in Virginia in which I resolved. I cannot afford a lawyer. What am I in for when I go to court next week?

The only defense you could have is if the other person testifies that they were driving. If the officer has sufficient proof that you drove to that point even if he did not see you, you could still be guilty. The Virginia DUI may count depending on how it was disposed of. You should ask for a Public Defender. If you do not qualify, you need to hire your own lawyer and borrow the money to pay for it. If you need further help, call our office.
