DWI for cocaine while on probation
My boyfriend was recently given a DWI for cocaine. He was in Gloucester county nj, his car ran out of gas and when the cop came he gave him a citation for DWI (not sure of how this came about---i wasn't there). My boyfriend is also on probation, which would send him to jail if they found out about the cocaine. What he needs to know is if a DWI is a criminal offense or will it be handled as a traffic offense. If it is a criminal offense, how much jail time could this bring, especially with him being on probation.

It is a matte of whether your boyfriend received traffic summonses or traffic summons and a criminal complaint for the cocaine. If only traffic summonses were issued they would not appear in the computer which records criminal arrests.

Driving Under the Influence of narcotics (cocaine) by itself is a traffic ticket. If the police officer also brought a charge for possession of cocaine, that would be a criminal charge. If your boyfriend is on probation in New Jersey then a conviction for DUI will not automatically result in a violaiton of his probation. However, if the probation officer finds out it was for cocaine, he can choose to violate your boyfriend's probation. I don't know what effect it would have on a PA probation since I am not licensed to practice in Pennsylvania. I have handled many cases like your boyfriend's in the past. Hopefully he was just charged with the DUI but if there is a possession cahrge then there is no doubt he will be violated. The DUI, if that is all there is, is still a serious matter. Please call me at 732-286-2170 to discuss this matter further as he should have representation for his charges.
