Legal Question in DUI Law in New Jersey

DWI Conviction

My question is simple really. I received a citation in East Brunswick, NJ 2 months ago for DWI and was convicted of that offense this past Tuesday, February 19th, 2008. The judge imposed a 3 month loss of license with some nominal fees to DMV, the State and the court. My lawyer was Richard Klein, he represents a large majority of the clients in and around East Brunswick, NJ. I decided to have the suspension and fines stayed until the final ruling in State vs. Chun. Two questions? 1)When should I expect the ruling to be passed on the alkotest? and 2)If my license becomes suspended in the event the ruling is unfavorable what are my options regarding acquiring a PA license as I will be moving out of New Jersey to PA for a business opportunity within the next 9 months? I appreciate your time in reading my question and offering advice. Thank you.

Re: DWI Conviction

Did you plea out? Most would say you should hear something soon, but many have been saying that for a while. I wouldn't plan on having your DL when they come out with it. I can't see them sending 1000's of cases right back to court. It would be a nightmare. I suggest you direct all DL questions in PA to PA DMV.

You should speak with Mr. Klein.

I do not know how you could have had a trial where the Alcotest results were permitted when the Supreme Court has not decided how it should be used.

It seems to me that a notice of appeal should be filed in order to preserve your position.
