Legal Question in DUI Law in New Jersey

DWI Discovery time frame

I was charged with a DWI on Jan6th and it is now February 26th. Today was my third appearance at court and to this date there is no discovery submitted to myself or the prosecutor. Thr 60 days are approaching and my next courdate is on March 26th. At that point in time it will be will over 60 days. What are the chances that I could get this dismissed?

You will have to file a motion to dismiss the charges before you can get the case dismissed. I would recommend that you hire a lawyer to assist you in this case. Are you doing this by yourself? I can't imagine a judge would even let you. Without an attorney, I doubt you will do much. Even with an attorney, you are facing an amazing uphill battle since it is DWI and it is municipal court.

You could always make/file the motion and see what happens. I assume this is a state police case. They always take forever with discovery.

Realistically, there is no chance. Dismissing a dwi is a no no.
