dwi guilty plea before the supreme court decision
I was arrested Sept 1,2007 for dwi in NJ. In the town of Boonton my lawyer plea bargained with no luck even with my cell phone on when I was being administered the breathalyzer test as well the town said that the video was malfunctioning & there was no audio that went along with the video..The officers report was contradictor. I know I passed the road test but again its my word against the officer's word and my lawyer thought it best to plead guilty and take the hit..3 months for just the officer's road side report or 7 months if the alcotest was seen as accurate by the supreme court. My court date is June 10,2008 and I feel like I should have fought. there were alot of discrepencies. Is it too late ever if I signed the guilty plea while I was waiting for the supreme court decision?

No, you can still fight and I suggest you explore that option. Get a good attorney and go for it!

At this point, the attorney who represented you at the plea is still your attorney of record. You should discuss this with him/her. Your plea can be withdrawn. State v. Chun requires that all electronic devices, including cell phones be removed from the area of the alcotest instrument.
