Legal Question in DUI Law in New Jersey
dwi 3rd offense afetr 10 years
IF you receive a DWI in 1984 first offense, then get a second charge of dwi 10 years later and they consider that a first offense because it has been 10 years since the first one. then 10 years later you get another dwi. will this be considered a second offense or third offense.

Unfortunately, a third is a third is a third. It does not matter whether your second was treated as a first.
However, you can go back and attack the first and second convictions, to bring the third down to a second or even a first.
There are MANY defenses to DWI. Please call me to discuss. Until then, please see my website

If there are fully ten years between the dates of each offense, this dwi might be deemed to be your first. It is probably a second offense. Some legal research is required. You can call me at 800 273 7933 to discuss your case and you can visit my website by clicking on www.dwitrials.com
