Legal Question in DUI Law in New Jersey

DWI Suspension

I was recently @ my pre-trial hearing for my DWI. The prosecutor offered a plea to 3 mos. rather than 7, and to drop the additional traffic tickets. The judge agreed, but the town police captain refused. Now I have a trial in July. If i am found guilty, can the judge ultimately overrule the mandatory 7 mos. suspension to something less?

I know this sounds self-serving, but a good lawyer would have made a difference (and probably still can....)

That sounds really wierd. I would defer to your attorney but I don't see how the judge can go lower than the 7.

If there is a lack of proof as to the reading, the judge can find you guilty of only the three month dwi violation.

Ultimately the sentence is up to the judge, and the police captain really should have no influence on the judge's decision.
