A friend got dwi at .10 and he wasn't drunk and i heard about the chun act but i need all the information i can get for the chun act

If his Blood Alcohol Concentration (BAC) was .10 he was legally intoxicated. You do not have to "feel drunk" to be legally intoxicated. Your friend should get a lawyer to help him as he is looking at a lengthy license suspension and possible incarceration if convicted.

The Chun Act that you refer to was a court case that determined that the new Alcotest machine used in New Jersey DWI cases was a valid machine to use. If your friend had a reading of .10 BAC then there is a presumption of intoxication. There may be a way to fight against this, but I would have to review all of the evidence before I can give you a definite answer. Please contact me to discuss this case in more detail. There are question which must be answered in order to decide what defense is available to your friend. The machine may have malfunctioned or your friend might suffer from some health condition which cause a false reading on the breath test machine.
