Hit by drunk driver what recourse do I have

Four month old new car totaled by drunk driver. Drunk driver arrested. I was taken to ER, glass cuts, neck injury, shock. My insurance co. will not pay for car rental, out of my pocket. $500 deductable otherwise full coverage, what does that mean?. Insurance co. said they will contact me to explain my options. By NJ insurance laws am I entitled to a new car replacement? Should I hire a lawyer to get compensations from drunk driver's insurance company? Should I sue drunk driver for damages? Do insurance companies have lawyers to work with policy holders? What rights and recourse do victims of drunk drivers have?
