Homeowner liability for over age 21 drinkers
What is a homeowners liability if someone over age 21 drinks, bringing their own liquor to your home? Is homeowner liable for any accident that the peson gets into when they leave your home? Are they responsible for limmiting the persons alcohol consumtion? The homeowner is not serving or providing any liquor

I would think that there would be no liability on the homeowner. But each case is fact specific such as did the homeowner know the person was intoxicated and let them drive home, etc. If you have a specific case and wish to discuss it please call 732-286-2170.

This is more of a civil liability question than a drunk driving question. There is nothing in the drunk driving law covering this question, but you can always be sued if someone got hurt by a drunk driver who had been drinking at your house. You probably would win a case like this if you got sued since it does not appear that you contributed to the person's intoxication. However, each case is different and unless you get sued you really can't tell if you would be liable. Plus your homeowners policy may have a clause covering this situation.
