New Jersey Surcharges

My husband received a DUI in 1986. He paid his fines and did his community service hours as required by the court to fulfill restitution. However, there were numerous surcharges added to his fine and they have plagued him ever since.

Numerous letters and phone calls have been made to straighten this thing out. He has been able to prove that he paid the ticket and they promptly removed this from his ''bill''. However, the State of New Jersey mailed him a notice of suspension from lack of payment of his surcharges. He did not and has never had a New Jersey Driver's License. However, he has been stopped from receiving a License in other States until he pays these surcharges he doesn't feel he owes. No explanation is being offered by the New Jersey authorities, and he is now unable to obtain a license, thus, unable to obtain work due to the fact that he does not have a valid State Driver's License in this State. Help!

Please be advised that I have not been retained to represent you and I am basing this reponse on the limited amount of information supplied. However, it sounds as though you have an administrative problem with the Court. Hopefully you have retained all the records of letters and documents which were sent to you in addition to your husband's original Court proceedings for the DUI. If so, look carefully as to what they say you owe. If you still believe that the Court is in error, make copies of all the documents (be sure to keep the originals) and send a letter with all the documents to the Court stating your position and asking the Court for an explanation. It could be even better to take all the documents to the Court and wait in person for an explanation but this could be a long day and you may not get answers on the day you appear. If you get nowhere, you should contact an attorney to review your documents and assist you. You may need a hearing to have a Judge decide.
