The police can choose to video tape an individual if they have been placed under arrest for DUI, they are not required by law to video tape a person who has been arrested. Many police cars are equipped with video cameras and they will often video tape the person when they are being asked to perform field sobriety tests. However, there is no law that requires the police to video tape someone. they must produce a video to the defense if one exists but a person arrested for DWI can still be found guilty by a Judge without a video. You should really consult an experienced municipal Court lawyer to discuss it in more detail. please feel free to call if you would like to discuss it further (201)-894-9498
