Legal Question in DUI Law in New Jersey

Medical problem leads to diluted drug testing result which is countes as a possi

I suffer from an anxiety disorder called paruresis, or Shy Bladder Syndrome. An estimated 17 million Americans suffer from some form of Shy Bladder Syndrome, about 7 percent of the population. While on probation for the past year I need to take piss test while someone is the room watching me. To do this I must drink large amounts of water before the time of my test, even after doing this it is difficult. My probation officer told me my test came back diluted I can only guess that ment too much water in the urine. The probation officer said she had no idea as to the definition of diluted when describing a urine sample but it sounds pretty self-explanatory to me. The procedure for a diluted urine sample is a second drug test and if that one comes back diluted it is counted as a positive drug finding, in which case I go back to court. Because of paruresis the only way for me to resubmit a urine sample was to drink large amounts of water. Now I have 2-3 weeks to wait to wait for the results. If anyone could advise me as to if have a case that would be greatly appreciated. Thank you

The short answer is that you might. Particularly if we can get a medical expert to testify as to the condition and the fact that you are diagnosed with it. I assume these are the first two samples you've given since being placed on probation. [email protected]

Does your probation officer know of this diagnosis? If so, he should wait until he receives medical proof that shy bladder caused your situation, before he decides to violate your probation. Sounds like your probation officer is not giving you the benefit of the doubt. Have you been prescribed any medicine to relax your pelvic floor muscles? sounds like your condition requires prescription medication, show this to your p.o.. Is Interstitial Cystitis part of your bladder problem too? That is also a serious bladder condition that causes all types of problems for people.
