NJ open container law

My niece was given a citation for having an open container of alcohol in a car, she was the passenger. We paid the $200 fine plus court costs. Now, trying to get insurance, Geico says that she has 3 points on her drivers license for drunk driving? She was not driving? Is this really the case?

The municipal court must have sent erroneous information to motor vehicles. You will have to have the municipal court correctd this mistake and then bring this correction to the attention of your insurance company.

Just wanted to add that some tickets may not give you MV points, but you can still get insurance points. Just call Geico and ask what happened.
