What penalties is my son looking at?
My 17 year old son just received the highest form of DUI, reckless driving, underage drinking, and criminal mischief. Besides the obvious suspension of his license what other penalties should he be expecting. What options do we have?

He is looking at maximum penalties including at least one year loss of his driving priveleges, thousands of dollars in fines, thousands of dollars in surcharges, five points on his license, juvenile detention (Jail), and a juvenile criminal record if he is convicted of everything. There are ways to minimize the penalties, however. I am an attorney who has handled many cases similar to your son's in various courts throughout New Jersey in the past. He doesn't have many options. He is facing criminal charges and thus, criminal penalties if convicted. This includes a criminal record, probation, jail, etc.

His criminal mischief charge should be handledl in juvenile court and the other charges should be transferred there. He is facing being placed on probation because imprisonment would not be justified unless he has a bad history on probation on prior charges.
