Legal Question in DUI Law in New Jersey

How do police determine whether alcohol was in a container? What type of fine should I expect to pay for an open container on the sidewalk in new Brunswick?

The officer never tested the cup as it was dumped before he walked over. I admitted I'd drank a little but I never said that particular cup contained liquor.

Do I need a lawyer for this?
