Legal Question in DUI Law in New Jersey
In the state of nj, if you are pulled over for suspicion of driving intoxicated, and you take the Breathalyzer test and blow a .06 two points the legal limit of .08, is that a dui? Or, can it lead to a conviction for a dui?

Yes, it won't be a per se violation but based upon a number of factors such as how you were driving, you could still be convicted. Call me to discuss if you'd like at 732/773/2768
The State would have a more difficult time trying to proof dui beyond a reasonable doubt. Call me, if you like.
