Third time DWI

Is there a law in Livingston, NJ that gives a Judge the right to suspend a 3rd time DWI from a jail sentence and give him 180 days in rehab or community service instead? Or, is a jail sentence mandatory in NJ?

It is possible to totally avoid a jail sentence for a third or subsequent dwi conviction by substiting first in-patient and then out-patient treatment of the drinking problem. A well crafted result through defense counsel can result in in-patient treatment in an approved facility for at least 30 days, the balance of 60 days in "intensive" out-patient treatment, and the remaining 90 days doing community service.
