Legal Question in DUI Law in New Jersey

Tomorrows Supreme Court Opinion on the Alcotest

Got and optomistic reply earlier this

evening about the supreme courts

anticipated opinion on the reliability

of the Alcotest. Does anyone have

any strong sence of what the court is

going to probably do? Does anyone

think they will actually find it

unreliable up to this point as not

having been used with the special

masters recommended proceedural

improvments. Or even simply the

confusion and problems of the

algorithym calculations etc....?

It is going to be a matter of what the state must prove as to the maintenance and use of the machine. The hearing master, retired Judge King

found the machine to be reliability under certain circumstances.

What are the circumstances of your Alcotest test?
