Legal Question in DUI Law in New Jersey

Wrong Information on Ticket

On my ticket that I was given for DWI they wrote the wrong make of,

color of, and year of my vehicle. In addition they have the wrong

VIN # on the release form for my car. This is because they had the

wrong registration for the car I was driving. Does this make it

invalid in any way or does it not even matter?

The error that you are describing would probably deemed a clerical error, or a "ministertial" error, and would not likely affeect the prosecution's case.

I will venture a guess that you know they used the wrong registration because it was the registration for another car you own. If I were the police and you brought this to my attention or tried to use this mistake, I'd write you a ticket for failing to have a proper registration.

Even if you had the proper registration with you at the time, this is a clerical error, and does not go to the offense.

Try a different approach to addressing your DUI.

In NY, as I understand it, that can be a basis to suppress the results of the arrest. Not so in NJ.

However, it may go to the officer's inattention to the facts of the case. If there are other things in the discovery (reports) that show his inattention, his credibility may be affected.

Please consult with an attorney that is well versed in trying these cases before you make any decision on how to proceed, i.e. don't just plead guilty.
