Legal Question in Elder Law in New Jersey
Completing a Power of Attorney
My mother-in-law has been in either a hospital or a rehab center for the past month. She wants my husband (her son) to have power of attorney. We received the forms to complete ourselves but are unsure what to list under the heading ''Purposes''. She wants him to have power of attorney over all her financial and health issues plus anything else allowed under this document. Also, who is allowed to be witnesses? Thanks for your help.

Re: Completing a Power of Attorney
I'm not sure where you got the power of attorney. Did an attorney prepare it? You should be careful about using "stationary store" power of attorney forms. They are often incomplete or do not grant the specific power needed.
As for signing the power of atorney, this would be done by your mother-in-law, not by you or your husband. I recommend that the witnesses be disinterested parties.
