Legal Question in Elder Law in New Jersey

Estate issues

My grandfather recently died and there are now many issues concerning his estate. He is survived by my grandmother. There is has been some question as to his mental competence as he kept signing the deed to his house over to various people as the fell in and out of favor with him. He signed the deed to the house and had it signed back to him at least four times in the past two years. Currently a cousin of mine holds the deed to the house. My grandparents have several children alive and there is concern that my cosuin has been using money in my grandparent's account for his own use. Additionally there are many items in the house, including coin and stamp collections, photographs and etc. that my cosin insists are his. My grandmother lives in the house with this cousin and his wife, and acquiesces to whatever they want. It is unclear if she is fully aware of what is going on. Is there any legal remedy, or course of action we should take to insure my grandmother is cared for?

Re: Estate issues

Yes,

You need to file whats called a guardianship action in the county where your grandmother lives. This entail a lot of work including getting 2 physicians to examine your grandmother and declare her incapacitated (if that is the case). If you would like to discuss this matter further please call me at 732-286-2170.
