Legal Question in Elder Law in New Jersey
My father is elderly and dieing of cancer. He wants to give his children and grandchildren $10,000.00 each for Christmas. When his health declines and needs to be placed in a Nursing Home, and the remainder of his money is exhausted to pay for the nursing home, does the government have to right to request the gift money he gave out returned.

This is too complicated for a short answer on this website; however, to the extent that it pertains to you and your family being contacted by some entity to return the money, the answer is no. It would serve your father well to get an elder care plan from an attorney that would seek to address such future concerns.
