Legal Question in Elder Law in New Jersey
Hello We need to get guardianship of my brother whom is mentally retarded and is going to lose his only home. Please offer any assistance you can.

I have done several of these, but unfortunately I am all the way up in Bergen County, so you would have to drive up to my office to meet me at least once.
That said, I can tell you that you will need affidavits from two doctors that he can not take care of things for himself, and then you file a guardianship action in the courthouse for the count that your brother lives in. Not all that complicated, but pretty hard to do without help from a lawyer.

Hello. Guardianships are initiated in the Probate Part of the New Jersey Superior Court in the County in which the "alleged incapacitated person" resides.
