Legal Question in Elder Law in New Jersey
Locating will and accounts
My dad (83) is in assisted living and has dementia. My stepmother is now divorcing him. How do I locate his will and bank accounts. She is not cooperative, and I don't know what she is trying to gain by this divorce.

Re: Locating will and accounts
I don't think she'll be able to get a divorce. I don't know. If he has dementia, he can't sign any papers. Some important facts are missing I think from your question. The only way you can get legal authority to access his financial records is by commencing a guardianship proceeding. I assume stepmom is dad's health care agent and power of attorney. Are you in Stuyvesant Town? Look for my ad in the Town and Village and give me a call. There's something else going on here.
Good luck.
