Legal Question in Elder Law in New Jersey
nursing home
My mom has alzheimers and has been in a nursing home for 4 months. She began having behavior issues, becomming aggressive to other residents. She was sent out to a psychiatric facility to get stabilized using meds. After 3 weeks there, they have declared her okay for discharge, no longer a threat to herself or others. Her nursing home is refusing to take her back, even though the treating doctor says she is better. Can they simply refuse her like that?

It depends; some facilities have "behavioral units which can better care for your mother; often in cases like this, I recommend that you consult with a "Geriatric CAre Manager" who can help you decide which is the best course.
