Legal Question in Elder Law in New Jersey
I have a question regarding protected services for the elderly in Bergen County New Jersey. Please let me explain my situation. Mother lives with me and is 90 years old five feet weighs between 105 to 89 pounds. She has a visiting nurse coming to the house every month. The house is in good condition and she is neat and clean. The nurse feels her weight is too low and also does not like my roommate or living arrangements. I feel the nurse should have worked with me to address her diet and depression before calling protected services. Social worker came to the house this week for a wellness check. He made some minor recommendations and offered some help in applying for services. Then he stated he would be back in a couple of weeks for another wellness check. Mother is in her right mind and indicated to him please do not come back. Can I refuse to let me in the house? If I do so can I be sued? What are my legal rights? How do I remove protected services? Can I force the social worker to make an appointment? I look forward to hearing your advice.
