Legal Question in Family Law in New Jersey

Is 50/50 settlement etched in STONE?

I'm separated from my wife. She walked out of our home 6 years ago. I have sole custody of our 3 children living in our home together. Their ages are 11, 14, 17. I know that my wife cannot force me to sell the home until my kids are emancipated. But what happens if we divorce before then? How is the house settled? I have retired due to an injury and am permanently disabled living on federal assistance. I don't have the money to buy her out and I wouldn't have enough money left from a sale of the home to buy something else. No longer working and having an income is a major consideration as well. In the 6 yrs she is gone, I have paid over $75,000 in mortgage/property taxes. Is any of that taken into consideration and would it affect the so-called 50/50 split when a husband & wife divorce? I guess I have a few questions to be answered.

50/50 is not etched in Stone! Yes, you do have alot of questions, and it would be impossible to answer all of them in this context. I offer a one hour no cost consultation to discuss matters in general. You need only call. Thank you! Rob Gleaner
