16 year old change in custody

my 16 year old son has stated when he comes for the month he

is not going back to his dads. his dad lives in nj also.

he has been abused physically and emotionally by his father and fathers girlfriend i want him here with me what happens if he just refuses to go back his father is extremely violent even after 14 plus years i am still scared of what he will do have been physically threatended even last year(no proof so cant do anything) what can his father do? and without custody can i change his school do not want him to skip any come sept. we live in 2 separate counties

Provided that the child is a teenager, the Court will give much deference to the child's wishes. However, as these cases are quite complicated and fact sensitive, I really need to learn more facts before drawing any final conclusions.

You need to file for an immediate change in custody. Based on what you have indicated, it appears that you could create a very persuasive case for a change in custody, especially since your son is at an age where he can basically determine where he wants to live, assuming he will testify in that manner to the Court. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion.
