Legal Question in Family Law in New Jersey

10 year old son was left alone

During my son's visitation with his father this past weekend he was left alone for at least 1 hour while his father and fiance went to the tanning salon. When he told me about this I questioned his father who confirmed the story. I think 10 yrs old and immature at that is too young to be left alone. I told his father that I wasn't happy and he blew me off and hung up on me. I have since tried to resolve this with him but to no avail. He is also a police officer and feels he is ABOVE the law and can do whatever he wants. What are my recourses or is there any type of guideline for a child being left alone.

Re: 10 year old son was left alone

Since it appears that you have nothing in writing which covers this situation, if both of you cannot come to an agreement, the Courts would be required to make a determination. It is unfortunate that the two of you cannot come to an agreement on such a simple issue. However, there can be a dispute as to the maturity of the child. If you brought a motion, it would be your burden to establish that your ex was placing your child in danger by doing what he did, in order to get a Court Order to keep him from doing this in the future. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob
