Legal Question in Family Law in New Jersey
after 16 years the mother sent me an e-mail apologizing for telling me the child was not mine, and said the child was indeed mine. by the way I have saved all important e-mails. A dna test is pending, results come soon. I have notice for a (hearing) for paternity, welfare reimbursement for past welfare given to the mother of the child, who may be mine, and child support. The child told me by e-mail that she has not lived with her mother in over 2 years. she lives with her younger brothers family in a different township and attends a high school in that township. Obviously the mother is committing fraud trying to get child support. I would gladly pay if she is my child. But the chils does not live with her. And what happens with the welfare reimbursement???? I will see a lawyer, but for now i need a few answers. And about how much will the lawyer cost?

Cost? Probably not that much, sounds rather simple once some of the details get ironed out. I have a few questions before I really give you an answer. Did you have any relationship with this child? If so, you may be stuck paying anyway. The child is owed support but it just might not get paid to the Mother. If the child is owed support, you will have to pay the welfare department. Call me at 732/773/2768 if you want to discuss further.
You definitely need a lawyer to fight being responsible for reimbursing all those years of welfare
benefits when you did not know you were a father. You need to assert the defense of laches, meaning that it would be inequitable to be required to pay for something when the claim for reimbursement is made at such a late point in time, due to no fault of your own.
Call me if you like.
This is so unfair and I am sure you are frustrated beyond belief.
The cost of an attorney might not be as devastating as you think..it might be a good investment as opposed to being stuck for all of that welfare reimbursement.
I handle your area and would be glad to talk to you...
