I have a 5 yr. old daughter in which I am the non custodial parent. I gave up custody when she was 2 and now have joint custody. I am filing for physical custody now that I'm stable and my Fiance works and Pays all the expenses. Can i regain custody of her? i am also a stay at home mom of a 2 yr old

You can regain primary residential custody, if living with you is in the better interest of the child.

You can fight for custody, now that you are stable. You will have to ask the Judge to order that you have custody, and you will get custody if the Judge is convinced that it is better for her to be with you than with whoever has custody now.
