Does a 16 yr old have rights in visitation

My daughter is 16 yrs old, and she doesn't want to visit her father, who lives out of state. She is involved in school activities, and is preparing herself to go to college. She is also looking for a job. She has told her father that she doesn't want to visit him anymore. She really doesn't like her father and has threatened to run away if she has to continue to see him. Does she have any rights?

Children who reach a certain age of maturity have a right to make their own decisions about visitation. There is no particular age; however, in your daughter's case, 16 would seem to meet the standard. From a realistic standpoint, I would think your ex would need to file a Motion to enforce his visitation. However, you could force the issue by filing your own Motion. The former choice would probably be preferred by you. Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained.
