Legal Question in Family Law in New Jersey
Absent father looking for parental rights after 11 years
My ex-husband left me when I was six months pregnant. He left the state
and I tracked him down and had his wages garnished. So I have received
weekly support. After 11 years he is asking that support be re-evaluated,
and that he receive parental rights....he wants my son to fly out to where he
lives (I am in NJ he is in Oregon) and visit him and his new family....
I clearly need to get a lawyer - is there any chance he could get visitation? I
am not concerned about the support payments

He can get visitation with your child. The question is whether he will go through the inconvenience that the state will require
The Court will not send you son to him until he
goes through some sort of break in period in which
he comes to New Jersey for visitation and undergoes some sort of evaluation of his home and family by probation in the court here he lives, at his expense.
