Legal Question in Family Law in New Jersey

Absentee parent moved out of state

I have lived in NJ for five years and his father lived in NY. He moved out of state to Ohio without notifying me. I only found out when probation sued him for lack of child support on my behalf. It was dismissed due to him not being a resident of NY. I am fairly sure he was supposed to have notified the courts and myself if he moved. Since he has failed to follow the custody agreement for as long as we have had it and abandoned our son, where would I petition, New Jersey where we have lived for years or Ohio where biological father has lived for several months?

You should file in New Jersey under the interstate compact on child support. Go to the Family Part in the county court of the county in which you reside

and advise that this is your desire. You will be assisted. He will be served with papers by the family court where he currently resides and they will compel him to respond to your complaint.
