Legal Question in Family Law in New Jersey

acess to my house

If I choose to get seperated and move out of my house just because we no longer get along. Can I come back and forth to see my children whenever I want and enter my house whenever I want

Re: acess to my house

So long as there is not agreement or Court Order to the contrary you have equal right to come and go from the marital home. However, you should be considerate of your wife and kids so they at least know you are coming or expect your. The best thing is to work out an agreement that you both can live with to avoid unecessary conflict.

Not knowing your spouse I can not predict how he or she will react to your coming and going without restriction. I know that my experience is that such coming and going at will is resented usually. The law aside, your spouse can keep you out of the house is he or she is determined.
