Legal Question in Family Law in New Jersey

how do i get achange in deduction status

the first few years after the divorce i claimed both kids. now he gets my younger son and i get my daughter who is about to graduate college. He pays very little child support and hasn't seen him or my daughter in many years. no birthday cards or contact. how do i change the status so i can now deduct my son.

In otherwords, what do i need to prove to the court to change the status?

You have to prove a significant change in circumstances from when the deductions were assigned by court order. You need to hire an attorney. I will charge you a reasonable fee.

You need to file a motion with the court. If this is all you are doing, you may not need an attorney although it'll never hurt to get one. I do suggest that you meet with one to go over everything to make sure you are getting everything you should.
