Legal Question in Family Law in New Jersey

Additional Child Support

A few years ago(4) my exwife contacted me stating she wanted more child support than the court granted her. I did have a new and better paying job, also I had a new family. Note that I also have never missed a payment starting in 1987. She said she would go to the District Attorneys Office to seek additional funds. I said that I could give her another $100.00 a month more but even that would hurt. She said that was not enough and I would be hearing from the court. About 2 weeks later she called and said that would be fine send the additional $100.00 a month which I have been doing. Both children are now over 18 and in college, can I legally cut back to my original amount of support, also can I send the support to the children instead of their mother? The divorce decree call for Post Secondery Education Support from both parents but does not specify that I must pay that to my exwife. Comments/Suggestions?

Re: Additional Child Support

I may be a little late in filing a response and you may have your answer but because the extra $100.00 was never included in a motion for child support, I do not see where your ex would be able to take you to court over that.

The post secondary education support is a part of child support. You can file a motion to reduce child support or attempt to conduct an audit of how much your ex-wife has contributed to the education.
