Legal Question in Family Law in New Jersey

adoption through marriage

I just got married and my new husband would like to adopt my daughter and give her our new last name. Would I lose my child support from her biological father if that happens?

Re: adoption through marriage

Your new husband would become permanently responsible for child support in place of your former husband as he would replace him as the child's father legally. You can call me at 800 273 7933 to discuss the matter further.

Re: adoption through marriage

In order for your husband to adopt your child, the child's father would have to consent, or you would have to file an adoption petition and would be involved in a contested adoption proceeding. If your husband does adopt your child, that would terminate the father's rights AND obligations, therefore, he would no longer be obligated to pay child support. Your husband would be assuming financial responsibility for your child. IF you would like to further discuss this matter, please feel free to contact my secretary, Debbie, at 856-795-6700 to schedule a consultation.
