Adoption of a minor child

I am a stepmother to a 16 year old male. My husband recently got custody of him because of the mother's instability. The child requested to live with us. He has no contact with her nor does he want to see her.

My question is can I legally adopt him even if the mother is still alive.

Yes, of course you can. If the mother does not contest it, it can be a rather easy and inexpensive process. Even if she does contest it, she may have a difficulty making a serious case against it.
