Adoptive Parents

My friend is a gay adoptive Mother, and she and her partner are divorcing, what rights does she have towrds the one child that they adopted together (the child is actually her soon to be ex's niece)?

If both legally adopted the child both will have rights to visit, etc.

Are both interested in obtaining custody of the child?

If only one legally adopted and they both raised the child as their own, that would be a different situation.

If she actually adopted the child then it would be the same rights as any divorcing couple. You have decide the custody issue first (usually the preference is for joint custody), and then determine who is the PPR and the PAR and set up a parenting plan.
