Legal Question in Family Law in New Jersey

Adultery?

I'm seeing someone who recently seperated from his wife. We were not seeing one another, nor were we even speaking before the marriage broke up. Can this still be considered adultery when he goes to court for his divorce?

The other party can make an allegation but they must have facts to support it. For example, they may name you as a 'repondent.'

Re: Adultery?

If the two of you were not dating prior to the marriage breaking up, and were not sexually involved prior to the marriage breaking up, then your boyfriend cannot be considered to have committed adultery with you.
