Legal Question in Family Law in New Jersey

Does adultry have a major impact on child custody?

I am married with two children. I am not a citizen of this country as of yet. I have been having an extramarital affair. I would like to obtain a divorce, however, I am afraid of loosing my children. My husband does have another child from a previous marriage, but he does not exercise his visitation rights or pay any child support. Does he have a chance to obtain primary custody based on these facts?

Re: Does adultry have a major impact on child custody?

Thank you for your inquiry.

Having an extramarital affair should not efect your ability to maintain physical custody of your child. Furthermore, you should certainly be paying child support.

As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.

Very truly yours,
