Legal Question in Family Law in New Jersey

Hello, At what age in the state of NJ can a child choose with whom they want to live with? My step daughter will be 12 in Feb of this year (2010) and she lives with her mom and sister. But she has been telling us she is not happy there and her mom and her get into physical fights and wants to move here with myseld and her father. Thank you so much :)

There is no real age as it depends upon the maturity of the child. You can file a motion to change custody on her behalf but speak to an attorney before you do. Call me at 732/773/2768 to discuss.

It is that the older the child the more the child's wishes are considered.

The violence she alleges is the strongest reason for changing custody.

If there is physical danger, this is a compelling reason for a change..
