Legal Question in Family Law in New Jersey
My soon to be ex is agreeing to sole custody with a limited parenting time schedule because of safety concerns and his lack of interest in both children. We were married for six years and in NJ we are supposed to split things equally. He runs of small truck company. I asked to keep all furnishings , and my own debt, he keeps his own debt, and for him to protect my name if he ever is audited . I filed my own divorce and was awarded a huge settlement since he does make a significant amount of money but tends to hide his earnings to avoid paying taxes. He filed a complaint for reconsideration and hired a lawyer because I was frightened I would not be able to guide myself through the court system especially since I have my kids all the time. We are trying to do a property settlement agreement, but my lawyer has said I verbally agreed to the child support and spousal support payments and now that I do not agree it is like I am being difficult and have not been taking his advice. My ex is claiming he makes $34,000 filed on his taxes, his 1099 states $125,00. His support payments would be $150 a week for our 2 daughters in child support and $125 extra a week in spousal maintenance that will end in 3 years. I originally only asked for 2 years of maintenance. I feel as though the support payments are low. I am being calculates at a worth of $18,000 and told I should get a job immediately so the support payments can go up when I add in child care expenses. I am just confused and want to make sure I am not signing something that devalues what I can actually have. I haven't worked in two years and I am constantly applying to jobs , so far I have been turned down from 4, offered one but at very minimal hours and pay. I want a job that will be somewhat of a right fit and I don't want to just pick any job.
