Legal Question in Family Law in New Jersey

Aimony and cohabitation

I was married for 18 years, divorced for 3. I have 3 teenage children who all live with me full time. The court ordered me to pay ex $150 a week permanent custody and no child support (shared custody). My ex is now letting her boyfriend spend 5 to 6 nights a week at her home. This is one reason why kids will not stay there. Can I prove cohabitation and have the alimony stopped? I know she has spent literally thousands of dollars in past year on trips, dinners, clothes and gifts for her boyfriend and is heavily in credit card debt. My divorce decree doesn't mention anything about cohabitation...did my lawyer miss something?....am I stuck paying until she remarries?

Re: Aimony and cohabitation

Thank you for your inquiry.

Not all divorce decrees discuss cohabitation. Nevertheless, you still maintain your rights to a potential termination or reduction of alimony. However, I need to learn more facts before drawing any conclusions.

It would be my pleasure to speak to you about your potential post-judgment divorce. Accordingly, please feel free to contact my office at 732 246 0909 to discuss further.

Very truly yours,
