Legal Question in Family Law in New Jersey
alimony
My boyfriend has been told his ex wife is married. He is prsently paying a lot of alimony. How can he find out if she is indeed married and get a copy of the marriage license without having to pay a large amount of money for a lawyer? Does he not have a right to this information?

Re: alimony
He certainly does have the right to the information; however, if he asks and she chooses to lie, then he has no alternative but to do what he needs to do to find out the truth. I would suggest that he ask her first. If she says she is, he can file a Motion to cut off alimony if she does not consent. If she says she isn't, and then he spends alot of money in finding out that she is, he may have the right to get an award of fees and costs once the Court makes a proper determination. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. If you have not retained an attorney, before you take any action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010.
