Legal Question in Family Law in New Jersey
Alimony Change of Circumstance
I was divorced in 1994 in NJ and now live in VA. My wife was awarded alimony and my pension was equitably distributed. In 2001 I was retired on disability from my job. At that time my wife also began receiving a monthly pension benefit. My decree states that I can request a alimony reduction after her income reaches $20,000. She also works.
1. Would this constitute a change of cricumstance?
2. Since I live in VA do I have to file a motion in NJ? She lives in Ocean County

1. Yes, 2. Yes.
I suggest you get an attorney to help you with this. These motions can be very difficult and she will likely fight to keep the alimony the same.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
Re: Alimony Change of Circumstance
You must make a motion in your divorce case for a reduction of alimony based on a significant change of circumstances. You must file in the courthouse where you were divorced.
