Alimony

Good morning,

I live in Massachusetts and my ex-wife lives in NJ with my 2 children.

our divorce decree stipulates that I have to pay Alimony. We did that because, when we divorced the children were 3 and 1 , now they are 10 and 12 and my ex-wife works full time now.

I did not do a temporary alimony, which I should have done.

Is it possible to have alimony removed now, especially that I re-married and I have 2 other children.

I have been told it is very unlikely, but I would like know the probability before going to court again.

You apparently want to modify your alimony obligation. What is required is a significant change in circumstances. I hope that her income has increased greatly.

If your former wife is working full time the odds a obtaining a modification of the alimony order are good. However, given the age of your children, any reduction and/or elimination of the alimony obligation would surely be accompanied by entry of a new child support order.

The fact that you have a new family with additional children to support would most likely not be considered by the court.

The other attorneys are correct, you have some chance, but these situations are always very dependent on the exact facts. I think it is worth the effort to get a consultation with a divorce attorney, and get an opinion.

In order to decrease or dismiss your alimony payments you will have to request a change in circumstances.
