Alimony Question
I was divorced in 2003. I receive permanent alimony of $2400 a month and child support of $2000 per month. I do not have a cohabitation clause in my settlement agreement. My boyfriend lives with me, and has for about 3 years. We have our own accounts. I pay all the same expenses, mortgage, electric, phone, taxes. He pays his own food and extra costs like my daughter's cell phone. Can I loose my alimony if he takes me back to court?

I just had almost the same case come into my office last week. The answer to your question depends upon who you get for an attorney and who he has for an attorney. For example, my other client's ex-attorney thought she had a loser case. I looked it over and I see about 5 ways to win the case, so it depends on if you have an attorney that will fight for you.

There is cohabitation and there is marriage. They are similar and different. It really boils down to what is in your property settlement agreement as to whether it is marriage AND cohabitation which terminate you alimony payments.
Sometimes a spouse may receive alimony in lieu of a part of a business; marriage or cohabitation should not effect slimony in such an instance.
